1. Acceptance of Terms

By accessing or using thebitmasters.com (the "Website"), submitting a contact or job application form, or engaging BITMASTERS SOLUTIONS - FZCO ("BitMasters," "we," "us") for services or products, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Website or our services.

2. Who We Are?

BITMASTERS SOLUTIONS - FZCO is a technology company licensed under License No. 69942 by the Dubai Integrated Economic Zones Authority (DIEZ), operating from Premises DSO-IFZA, IFZA Properties, Dubai Silicon Oasis, Dubai, United Arab Emirates. We provide AI automation, chatbot development, web and app development, custom business systems (ServeHub, StaffHub365, SyncHub), and SEO services.

3. Use of the Website

You agree to use the Website only for lawful purposes. You must not:

Attempt to gain unauthorized access to our systems or any account not belonging to you.
Use the Website to transmit malicious code, spam, or unlawful content.
Scrape, copy, or reproduce Website content for commercial purposes without our written consent.
Misrepresent your identity when submitting the contact or careers form.

4. Services and Products

4.1 Services

(AI automation, chatbots, web/app development, custom systems, SEO) are provided under a separate service agreement, proposal, or invoice agreed between BitMasters and the client. These Terms govern the Website itself; specific project scope, timelines, fees, and deliverables are set out in the applicable signed agreement, which takes precedence over these Terms in case of conflict.

4.2 Products

(ServeHub, StaffHub365, SyncHub) are provided on a subscription or license basis as described in the relevant product agreement. Continued use of a product is subject to timely payment of applicable fees. We reserve the right to suspend access for accounts with overdue payments, with prior notice where reasonably possible.

5. Intellectual Property

5.1 All Website content — including text, graphics, logos, product names (ServeHub, StaffHub365, SyncHub), and design — is the property of BitMasters or its licensors and is protected by UAE and international intellectual property law. You may not reproduce or redistribute this content without written permission.

5.2 Unless otherwise agreed in a signed project agreement, custom deliverables (websites, apps, chatbots, systems) built for a client transfer to the client's ownership only upon full and final payment. Any underlying frameworks, code libraries, or reusable components developed by BitMasters remain BitMasters' intellectual property and may be reused across other client projects.

6. Fees and Payment

Fees for services and products are as agreed in the applicable quote, proposal, or invoice. Unless otherwise stated, invoices are due within the timeframe specified on the invoice. Late payment may result in suspension of services, products, or ongoing support, and may incur late fees as permitted under UAE commercial law.

7. Warranties and Disclaimers

7.1 7.1 We aim to deliver services and products with reasonable skill and care, consistent with industry standards.
7.2 7.2 Except as expressly stated in a signed service agreement, the Website and general information provided on it are offered "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
7.3 7.3 We do not guarantee specific business outcomes (e.g., specific search rankings, lead volumes, or automation savings) as these depend on factors outside our control, including third-party platform changes (e.g., Google, Meta/WhatsApp algorithm updates).

8. Limitation of Liability

To the fullest extent permitted under UAE law, BitMasters' total liability arising from any claim related to the Website or a specific engagement shall not exceed the total fees paid by the client for the relevant service or product in the three (3) months preceding the claim. BitMasters shall not be liable for indirect, incidental, or consequential damages, including loss of profits or business opportunity.

9. Third-Party Services

Our services may integrate with third-party platforms, including WhatsApp Business API (operated by Meta), payment gateways, hosting providers, and other software integrations requested by the client. BitMasters is not responsible for outages, policy changes, or fee changes imposed by these third-party platforms, though we will make reasonable efforts to notify affected clients.

10. Confidentiality

Both parties agree to keep confidential any non-public business, technical, or financial information shared during the course of an engagement, except where disclosure is required by law or UAE regulatory authority.

11. Termination

We may suspend or terminate access to the Website or a product for violation of these Terms. Service agreements may be terminated according to the notice period and conditions specified in the applicable signed agreement.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Arab Emirates and, where applicable, the regulations of the Dubai Integrated Economic Zones Authority (DIEZ). Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Dubai, UAE, unless a separate signed agreement specifies arbitration or another dispute resolution mechanism.

13. Changes to These Terms

We may revise these Terms from time to time. Continued use of the Website after changes are posted constitutes acceptance of the revised Terms.
